RCX 360 View (App) Agreement

Effective: 29 April, 2023

This RCX 360 View (App) Agreement ("Agreement") is made between RCX Pty Ltd ("RCX," "we," "us," or "our") and you ("Client,” “user," "you," or "your") and governs your use of the RCX 360 View App ("App") and any services accessible through the App (collectively, "Services"). By downloading, installing, or using the App or Services, you agree to be bound by the terms of this Agreement.

1. Access and Use

  1. RCX grants you a non-exclusive, non-transferable, limited right to download, install, and use the App and Services for your internal business purposes.
  2. You agree to use the App and Services only in accordance with this Agreement and any applicable laws, regulations, or policies.
  3. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2. Proprietary Rights

  1. RCX owns and retains all right, title, and interest in and to the App, Services, and any related intellectual property rights.
  2. You agree not to reverse engineer, copy, modify, distribute, or create derivative works of the App or Services.

3. Data Privacy and Security

  1. RCX agrees to comply with its privacy policy available at PRIVACY POLICY HERE and any applicable data protection laws in connection with the processing of personal information under this Agreement.
  2. You agree to comply with your privacy policy and any applicable data protection laws in connection with your use of the App and Services.

4. Confidentiality

  1. Each Party agrees to keep confidential all non-public information disclosed by the other Party in connection with this Agreement and to use such information solely for the purpose of performing its obligations under this Agreement.

5. Disclaimer of Warranties

  1. RCX provides the App and Services on an "as is" and "as available" basis. RCX makes no warranties, express or implied, regarding the quality, accuracy, completeness, or reliability of the App or Services.

6. Limitation of Liability

  1. To the fullest extent permitted by law, RCX and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, consequential, incidental, punitive, or special damages arising out of or in connection with your use of the App or Services.

7. Termination

  1. RCX may suspend or terminate your access to the App or Services at any time, with or without notice, for any reason, including but not limited to violations of this Agreement, our Privacy Policy, or any applicable laws or regulations.

8. Modification of Agreement

RCX reserves the right to modify this Agreement at any time. Any changes will be effective upon posting the revised Agreement within the App. Your continued use of the App or Services after the posting of any changes constitutes your acceptance of those changes.

By using RCX's Services, you acknowledge that you have read, understood, and agreed to be bound by this RCX 360 View (App) Agreement
