Platform Agreement

Platform Agreement for RCX Pty Ltd.

This Platform Agreement ("Agreement") outlines the terms and conditions for users ("Client,” “user," "you," or "your") accessing and using the services provided by RCX Pty Ltd ("RCX," "we," "us," or "our") through our website, applications, or other digital platforms (collectively, "Services"). By accessing or using our Services, you agree to the following terms and conditions:

1. Acceptance of Terms​

By accessing or using our Services, you acknowledge that you have read, understood, and agreed to be bound by this Platform Agreement, as well as our Privacy Policy and any other applicable terms, conditions, or policies (collectively, "Agreements").

2. User Eligibility​

Our Services are intended for individuals who are at least 18 years old or the age of majority in their jurisdiction, whichever is older. By using our Services, you represent and warrant that you meet this eligibility requirement.

3. User Account and Security​

In order to use certain features of our Services, you may be required to create an account. You agree to provide accurate, current, and complete information during the account registration process. You are responsible for maintaining the confidentiality of your account credentials and any activities that occur under your account.

4. Use of Services​

You may use our Services only for lawful purposes and in accordance with this Platform Agreement. You agree not to:

  1. Use our Services in any manner that violates applicable laws, regulations, or third-party rights;
  2. Engage in fraudulent or deceptive practices, including but not limited to phishing, spoofing, or unauthorized scraping of content;
  3. Attempt to circumvent, disable, or interfere with any security-related features of our Services;
  4. Distribute or upload content that contains viruses, malware, or other harmful code; or
  5. Reverse engineer, decompile, or disassemble any part of our Services.

5. User Content​

You are solely responsible for any content or materials you submit, publish, or display through our Services ("User Content"). You agree not to post or share any content that infringes on third-party rights, violates applicable laws, or is offensive, defamatory, or otherwise inappropriate. RCX reserves the right to remove or modify any User Content that violates this Platform Agreement, Privacy Policy Agreement or our Prohibited Business Agreement.

6. Intellectual Property​

All content, logos, trademarks, and other materials featured on our Services, excluding User Content, are the property of RCX or its licensors. You may not use our intellectual property without our prior written consent.

7. Third-Party Services​

Our Services may integrate with or contain links to third-party websites, applications, or services. RCX is not responsible for the availability, content, or privacy practices of such third-party services. Your use of these services may be subject to additional terms and conditions imposed by the third-party providers.

8. User Interactions​

You acknowledge that RCX is not responsible for the conduct of other users of our Services. Your interactions with other users are solely between you and such users. You agree that RCX will not be liable for any claims, damages, or losses resulting from such interactions.

9. Disclaimer of Warranties​

RCX provides our Services on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the quality, accuracy, completeness, or reliability of our Services or any content or materials provided through our Services. You acknowledge that the use of RCX's Services is at your sole risk.

10. Limitation of Liability​

To the fullest extent permitted by law, RCX and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, consequential, incidental, punitive, or special damages arising out of or in connection with your use of our Services. This includes, but is not limited to, loss of profits, business interruption, loss of data or information, or any other pecuniary loss. RCX's total liability to you under this Agreement shall be limited to the amount paid by you to RCX for the Services during the 12 months preceding the event giving rise to such liability.

11. Indemnification​

You agree to indemnify, defend, and hold RCX harmless from any claims, damages, or expenses arising from your use of our Services, any violation of this Platform Agreement or our Privacy Policy, or any third-party claims relating to your User Content or actions.

12. Modification of Agreement​

RCX reserves the right to modify this Platform Agreement at any time. Any changes will be effective upon posting the revised Platform Agreement on our website or applications. Your continued use of our Services after the posting of any changes constitutes your acceptance of those changes.

By using RCX's Services, you acknowledge that you have read, understood, and agreed to be bound by this Platform Agreement.
